There were two passengers in Menfi’s car at the time of the shooting, according to court documents. They were arrested and questioned shortly after the shooting.
One of them told investigators that Minifie thought someone was following them after they stopped at a gas station where they were going to play gaming machines, so they left.
As they drove, the witness said Minifie identified Banks’ SUV as the vehicle he believed was following him. The witness said he stopped next to the SUV and fired several shots at the vehicle.

Police officers found Banks’ SUV parked on a pier along the west bank of the bay. Banks was pronounced dead at the scene from his injuries, which appeared to have been caused by a gunshot wound to the head. A man riding in an SUV was shot in his left arm and pelvic area. He was transferred to an area hospital for surgery. Banks’ 3-year-old son was also in the SUV but was not injured.
The witness in Menfi’s car told investigators that they continued driving despite having a flat tire. About five minutes later, she said Menefee stopped the car in a turning lane on West Mount Houston Road, took the keys and fled the scene.
The other passenger in Menfi’s car was also arrested and interrogated. He told investigators that he was sleeping in the back seat when he heard the tire explode. He said that Menfi continued driving and then sped off when the car stopped.
After nearly two months as a person of interest, Menefee was charged with murder on October 25.
